Since when is war supposed to be ethical? In fact, IMO it's more accurate with crews dying in the blaze, instead of our wars being reduced to clinical little affairs. Sure, war isn't cute and represents a grave matter in real life, but I don't think the games we play should in any way downplay these things.
The CONCORD rules for legal wars are somewhat odd, yes. Even if there weren't crews, there's still people dying (the pod pilots). However, the war system is there to let us "live a little".
It's a cruel future we're dreaming in.
